nTaxTreatyin1985,ithasbeethelegaltesttosolveissuesconcerningdoubletaxationandevasion.However,aftereffectingoftheTreaty,taxreformskeepbeingbroughtupinChinawhichhasledtoneweconomicandtradeformsbetweenthetwocountries.Also,withtheevolutionofinternationaltaxlawlogic,itisofnecessitytorevisetheTreatytosomeextent.ThoughChina’scapitalinvestmenthasbeenincreasinginGermany,wemustnotignorethefactthatChinaremainsacapitalimportingcountryparedwithGermany.Assuch,whilerevisingtheTreaty,Chinashouldhighlightthejurisdictionofsourcecountrywhilsttakingintoaccountthejurisdictionofresidencestate.
