[Abstract]ThispaperreviewstheacademicdebateonthelegitimacyofpublicadministrationinAmericaduring1990s.Theauthorarguesthatthefundamentaldifferencebetweenthecontroversiesisthemethodology.Thecontractualismadvocatethatitshouldbegroundedinthelogicofaconstitutioningeneralthatpertainstothecheckingofpower,yettheinterpretivismadvocatethatitisfirmlyrootedinlegislativemandate.ThispaperpointsoutthatthelegitimacyofpublicadministrationisnotonlyaproblemoftheinheritanceoftheConstitutionandthedefenceofit,butalsoanissueofhowtomakethelivingconstitutionhaveacoevolutionaryrelationshipwiththepolitics,theeconomyandthesociety.
