ThispaperiscomparativestudyontheLibrettosofacontemporaryRapperof“Gesar”whonameisZhaBa.Duringmystudyforamaster'sdegree,Ihadgatheringthedifferentlibrettoversionsof“Gesar”byZhaBa.formanytimesfromeveryTibetanarea.Inthreeyears,therearethirteenversionstocollectedtotal.Duringthewritingofthispaper,ImakethepreliminaryscreeningtotheselibrettoswhatwererapsbyZhaBa.IhadcompardandstudiedtothemostrepresentativelibrettosAmongthem.Thefivelibrettosare“Lhagling,Mongling,Sumpamdzordzong,HorphyiparardzongyBhagala3phrulgyirgyalpo.”

Abstract
Asoneoftherapid-developingtransportsystemintheworld,especiallyknownasitsfeaturesofhighefficiency,low-energycostandlargetransportingcapacity,therailwaysystemhasbeenplayinganimportantroleinthetransportationindustry.Ontheotherhand,therailwayhubisawindowofthecity,whichreflectsthepublicimpressionofthecity.Apartfrombeingasupplementtothewholebuildingclusteroftherailwayhub,thelandscapeinfrontoftherailwayhubcanprovideservicetothepeopleinthehub.
Withtheeconomicboomingandthedevelopmentofsocialconstruction,thebuildingsoftherailwayhubpresentthefeaturesofarchitecturalstylediversification,materialdiversificationandricherlook.However,itiseasytoignoretheenvironmentalharmonyofthehubwhenweareattractedbytheexcellentconstructionofhub.Theidealrailwayhubenvironmentshouldbeinthiswaytheconstructionsandlandscapeshouldcomplementeachotherandmakepeoplefeeltheculturalatmosphere.Theenvironmentalharmonycanembodythecharacteristicofthetimesandboostthedevelopmentofthehumancivilization.

Thedefinitionof“thecrimeofdisruptingpublicservice”incurrentCriminalLawisdrawnfromsummaryofthepoliciesfromCriminalLaw1979version.CurrentCriminalLawhasintegratedthespecificrulesfor“thecrimeofdisruptingpublicservice”intoaunifiedone.Meanwhile,thecurrentversionhasdifferentiated“thecrimeofdisruptingpublicservice”from“ObjectionofImplementationforCourtDecision”basedonarticle157thofthecriminallawof1979version.Sothat“Oneruleleadstooneaccusation”hasbeenrealized.Studyandunderstandingofthetheorycircleofthecriminallawonthecrimeofdisruptingpublicserviceinourcountryisstillnotdeepenoughandtherearevariousopinionsonthespecificjudgmentofthecrime.Andinthepracticeofjudicature,certainjudicatureexplanationsarelackingtodealwithcases.Alltheseleadtojudicialpersonnel'sdeviationandmisjudgmenttosomeextentindealingwiththecasesandresultsinthevaguedistinctionbetweencrimeandnon-crimeanddifferentsentencesofidenticalcases,whichseriouslyinfluencestheimpartialityandseriousnessofjudicialwork.Inconsiderationofthis,I'minattempttoadopttheformofraisingquestions,teasingoutcurrentstudyachievementandvariousopinionsontheknottyproblemsaboutthiscrimeandanalyzingrelatedcasestostudyanddiscussseriesofdifficultiesinthejudicialpractice.
Thethesisisdividedintothreechapters.Chapter1and2refertothethematicstudyonthecertainproblems.Chapter3emphasizesonthefurtheranalysisanddiscussionabouttherelatedproblemsofcrimeofdisruptingpublicserviceonthebasisoftheformerchapters.
Chapter1focusesontheobjectofcrime.Thischapterisdividedintothreepartswhichrespectivelystudyandanalyzetheconstitutionoftheobjectofcrimefromthreeperspectives:firstly,theobjectofcrimeshouldhavetheidentityofstatepersonnel;secondly,thebehaviorofperformingdutybytheobjectislegal;thirdly,theobjectisintheprocessofperformingduty.ThischapterillustratestheconceptofstatepersonnelandraisesdistinctargumentaboutwhetherthestaffsintheChineseCommunistParty,thedemocraticparties,urbanmanagementbureauandotherrelatedpersonnelcanbetheobjectsofthecrimeornot.Inthenextplace,throughtheanalysisofrelatedcases,thescopeofthe“law”bywhichcivilservantsperformsdutyissetscientificallyandtheclearviewofthejudgmentmethodandthestandardtojudgethelegitimacyofactofdutyisputforward.Intheend,fromtheintentionofthelegislators,Iraisetheviewpointthat“thepreparatorystageisalsoestablishthecrime”andputforwardmyownviewsonthejudgmentstandardfor“officialbusinesshasbeenexecutedcompletely”.
Chapter2mainlydiscussesthebehaviorofthecrime.ItisforthejudgmentwhetherthebehavioraccordswiththeconstitutionofthecrimethatIneedtosummarizeclause277ofCriminalLawofChinawherecrimeofdisruptingpublicserviceisidentified,whichmeansthecrime'sdefiniteness,obstructiveandparticularity.Onthisbasis,twospecificmeans,violenceandthreat,whoselegalformanddegreearediscussed,aredeeplystudiedtoprovideareferencetosolvethespecificproblemsinthejudicialpractice.Inaddition,Iputforwardmyownopinionaboutsomespecialsituationswhichmaybemetinpracticaloperationofthejudicialorgans.
Chapter3discussesaseriesofproblemsrelatedwithcrime,includingtherequirementsofthecrime,theinfluenceoftheactor'ssubjectivesinontheconvictionandsentenceofthecrimeandthepatternofcrimenumber.Requirementsofthecrimearethekeytothejudgewhethercertainbehavioraccordswiththeconstitutionofcrimeofdisruptingpublicservice.Frommyperspective,itshouldberealizedthattherearedistinctdifferencesbetweenthebehaviorofdisruptingpublicserviceandjustifiabledefense,generalunlawfulactsorminorviolations,furtherlimitingtheconditionsofcrimeofdisruptingpublicservice.Additionally,Imaintainthatthesubjectivesinoftheactorisofgreatimportancetothejudgmentofthecrime.
Throughtheanalysisofthespecificcase,itisreachedthat“usingviolencetoescapefrompunishmentmeetsthesubjectivecontentofthecrime”andthat“usingviolencetoattackandretaliatecannotbeattributedtothesubjectivecontentofthecrime”.Atlast,thepatternofcrimenumberisdiscussedandIwillfocusontheresearchofconcurrenceofarticlesoflawbetweenthecrimeandthecrimeofdisruptingtheorderofthecourt,theimaginativejoinderrelationshipbetweenthecrimeandthecrimeofintentionalinjuryandcrimeofintentionalhomicideandofferingaproposalthattheregulationsofimplicatedcrimesshouldbefurtherperfectedinCriminalLawofourcountry.
